Fortunately, Title VII of the Civil Rights Act of 1964, was amended in 1978 to include an amendment know as The Pregnancy Discrimination Act (“PDA”). The act specifically prohibits discrimination based on a woman’s pregnancy. When an employee is discriminated against simply because they are pregnant, ready to give childbirth; or, are suffering medically complicated conditions based on their pregnancy, Title VII affords you protection. For example, an employee cannot be fired because they have announced their pregnancy or because they ask for reasonable accommodations and changes to their work responsibilities in order to stay healthy. There are many more protections that are afforded to pregnant individuals and you should contact us immediately if you believe you have been discriminated against on this basis.
